When a loved one dies, as an Executor named in their Will or as a family member or friend, you will need to apply for probate unless all their assets are shared with a surviving partner. 
 
This initially involves obtaining a Grant of Probate or Letters of Administration so that their estate can be administered as they would have wished.

One or more named people will be given legal authority to close bank accounts, sell property, settle debts and to do anything else needed to finalise a loved one’s affairs. 
 
Completing the paperwork, dealing with the authorities, selling property and belongings, and dispersing the estate can be a challenging and sometimes frustrating process, which is why I offer this service.

the steps you will need to take such as obtaining a death certificate and an assessment of the value of property and other assets in addition to any money held in bank and building society accounts, for example 
the documents that will be needed to submit a tax return and probate application papers, which can vary depending on the value and complexity of the estate 
the information that will be needed to complete the documents 
 
The service is provided for a fixed fee. 

What is Probate? 

One or more people will need to administer someone’s estate when they die unless all their assets are shared. Probate is based on the assets in their estate and who will inherit them. 
 
If someone has a valid Will when they die a Grant of Probate for their estate is needed. If they die intestate (without a Will) a Grant of Letters of Administration is needed instead. 

Can I Manage Probate Myself? 

Yes, you can. 
 
People often use a solicitor to handle probate on their behalf, but you don’t have to. Using a solicitor can be expensive and fees could be subject to VAT, adding an additional 20% to the cost. 
 
The fee is often linked to the value of the estate so the figures can be significant. 

How Long Does Probate Take? 

The government says you will normally receive a grant of probate or letters of administration within 16 weeks. Many factors affect how long the probate process can take. 
 
Since 2020 you can apply for probate online but if there are any errors or omissions the process will be delayed. Paper forms can also be submitted which are likely to take longer.
